Right of Way Support Materials for Direct Recipient Grants

Project Abstract:
The Federal Highway Administration (FHWA) expects an increase in the number of direct-recipients of Federal funds from Rebuilding American Infrastructure with Sustainability and Equity (RAISE) and similar direct funding sources to carry out transportation projects of local and/or regional significance. The stewardship of the typical Federal-aid project relies on well versed and experienced State Department of Transportations’ (SDOT) compliance and implementation of Federal-aid projects and programs. The SDOT carries out the project or program following the processes and procedures outlined in their FHWA approved SDOT right of way (ROW) manual which provides details on the requirements that must be met when acquiring needed real property for a Federal-aid project. In some instances, the SDOT may provide Federal-aid funding to Local Public agencies (LPA) who will carry out a transportation project or program with the SDOT being responsible for oversight. The LPA will either use the FHWA approved, State ROW manual or develop and use their own LPA ROW manual which the SDOT has approved. However, there is not a similar requirement that direct-recipients of Federal funds, have an FHWA approved ROW manual. This creates a unique challenge to FHWA who would be tasked with providing ongoing, daily, project level reviews and oversight instead of the SDOT. This stewardship challenge will require that FHWA Division office staff provide daily oversight of these ongoing projects.
The goal of this research project is to develop the following direct-recipient, ROW stewardship and oversight resource materials that FHWA can recommend to direct-recipients to assist them in the development and implementation of their ROW acquisition processes and procedures that meet current Federal requirements.

The outcome of this project is the development of the following resource materials to assist FHWA Division personnel in the stewardship and oversight of direct-recipient projects and to assist the direct-recipients in the development of their own Federally approved ROW procedures.
