Outdoor Advertising Control Case Studies and Report
Project Information
This project consists of conducting nine case studies for States selected by FHWA at project start. The States will, most likely, have recently amended their outdoor advertising laws in response to recent court decisions. The results of the case studies will be documented in a final report. The case studies will analyze the following:
• Which existing state laws relate to the Highway Beautification Act?
• How did the State legislature amend their statutes in response to the court decisions?
• What corresponding changes were made to the implementing regulations?
• How does the revised legislation attempt to redefine on-premise signs in a content neutral manner?
• Apart from on-premise signs, what other changes were made to the legislation?
• In the affected States, what has been their experience with implementation of the new statutes and regulations?
This effort will require review of a number of different sources, including Federal and State court cases, Federal and State legislation and regulations, and interviews with outdoor advertising program managers from the relevant State Department of Transportations (DOTs) and/or other relevant authorities.
